Service terms

The terms of the video and photo work, for professionals and businesses. Private individuals receive dedicated terms. DRAFT, pending review by a lawyer.

Version v1.3 (draft) · in force from 12 October 2026

0. Status of this document

This is a draft. It is written on the real exposures of this business and published because a service with no terms is worse than one with provisional terms, but it has not been reviewed by a lawyer. It will be replaced after review.

1. Who provides the service

Davide Nero, sole trader, Italian VAT number 04051930131, registered at Via Salvo D'Acquisto 197, 22038 Tavernerio (CO), Italia.

Contact: WhatsApp on the number shown on the site, or info@luneaistudio.com.

2. Who these Terms apply to

These Terms govern relations with professionals and businesses, that is with anyone acting in the course of their trade, business, craft or profession. Before accepting an order we ask for a VAT number and company name.

For private individuals we send dedicated terms before the order. The service is open to people without a VAT number too, but that relationship is governed by a different text: the law gives consumers protections a business-to-business contract does not provide, and applying this document to them would be both unfair and ineffective.

So the first thing we ask is whether you are writing as a business or as a private individual. Which text you receive follows from that.

3. The two ways to start, and what we deliver

Work starts in one of two ways, and the difference is not formal: from your photos, in which case the content shows what is in the photos you send; or from a brief, in which case the content is generated with artificial intelligence and does NOT depict real places, properties or people.

⚠️ Content created from a brief must not be presented as footage of real places, nor as images of your premises, your rooms or your shop. We declare what it is, on delivery and here; whoever publishes it answers for their own communication.

The exact contents of each package are those shown on the site at the time of the order, confirmed in writing in chat before we start. We deliver video and image files in the agreed formats, ready to publish on your channels.

Music is not included, unless agreed otherwise in writing. Videos are delivered with no music track: a licence in our name would not cover your publication. Music is added when you publish, from the library of the platform you publish on and under that platform's rules.

We do not deliver: source projects, material that was not requested, or the management and publishing of content on your profiles.

4. Timing

48 hours from the arrival of the complete material, not from the first message. Material is complete when we have all the photos needed and the information required to work on them.

If what arrives is incomplete or unusable we tell you before starting, and the clock starts when we receive what is missing.

5. Revisions

Two revisions are included in every package. A revision is a change to material already delivered: framing, pacing, scene. Further revisions are agreed — on timing and price — before they are carried out.

Not revisions: a change of product or setting from what was agreed, or new work on different photos. That is a new order.

6. Price and payment

The price is the one shown on the site for the chosen package, or the one agreed in writing for tailored work.

Payment is by bank transfer, with an electronic invoice: 50% on order and the balance before the final files are delivered. You see the previews before paying the balance; the publish-ready files arrive once it is settled.

Prices shown on the site are exclusive of VAT where applicable, according to the relevant tax regime.

7. The material you send us

By sending us photos or other material you declare that you are entitled to do so: that you own the rights or have permission from whoever does, and that any identifiable people in it have consented.

⚠️ Send only photos with no recognisable people. The material you send must not show identifiable faces or people. This is not a style preference: it is how we keep out of the work data that would require each person's consent. If someone appears in a photo we flag it and ask you to replace it.

You authorise us to use that material solely to carry out the work you commissioned.

If the material infringes third-party rights, the responsibility is yours and you hold us harmless from any claim arising from it.

8. Rights in what we deliver

Once payment is made, the content we deliver is yours to use with no time limit, on your channels, your website and your paid campaigns, in Italy and abroad.

One limitation remains, imposed on us by the model providers and therefore passed on to you: you may not use this content to develop, train or improve artificial intelligence models or services.

We do not grant exclusivity: similar content may be generated for others. And note that in the European Union, content generated by artificial intelligence without significant human creative input may not be protected by copyright.

We may show completed work as an example in our portfolio. If you would rather we did not, just say so.

9. Content generated with artificial intelligence

The content we deliver is generated with artificial intelligence, and we always say so. It is not real footage: it is images and video built from your photos.

Your photos are processed by third-party artificial intelligence providers, including providers established outside the European Union. The current list is in the service privacy notice.

When you publish this content, declaring that it is AI-generated where the platform or the law requires it is up to you. We publish nothing on your behalf.

10. Limits of liability

Content is supplied for the agreed promotional use. We guarantee no commercial result: visibility, enquiries, bookings or sales do not depend on the material alone.

To the extent permitted by law, our total liability towards you is limited to what you paid for the work the claim relates to. Liability that the law does not allow to be excluded remains, including wilful misconduct and gross negligence.

11. Governing law and jurisdiction

Italian law applies. The Court of Como has exclusive jurisdiction over any dispute, these being business-to-business relations.
